HRA DURING CHILD CARE LEAVE

Subject:- Clarification on the admissibility of House Rent Allowance (HRA) during the Child Care Leave (CCL) – Reg.



The undersigned is directed to refer to Para 6 (a)(i) of this Ministry’s O.M. No.2(37)-E.II(B)/64 dated 27.11.1965, as amended from time to time, on regulation of House Rent Allowance during Leave which stipulates that a Government servant is entitled to draw HRA…… during total leave of all kinds not exceeding 180 days and the first 180 days of the leave if the actual duration of leave exceeds that period; but does not

include terminal leave, ……. It has also been stipulated, thereunder, that drawal of the allowance (HRA) during the period of leave in excess of first 180 day availed of on grounds other than medical grounds mentioned in sub-para (ii), shall be subject to furnishing of the certificate prescribed in Para 8(d) of the G.M. ibid.



2. This Ministry has been receiving representations from the female employees that certain Central Government Ministries/Department/Establishments are not allowing HRA during the Child Care Leave (CCL), especially when taken in continuation of Maternity Leave of 180 days. The reason for their reluctance may be the fact that CCL has been first introduced on the recommendations of the 6th Central Pay Commission, though the Department of Personnel & Training (DoPT), vide their O.M. No.13018/1/2010-Estt.(Leave) dated 07.09.2010, inter-alia, reiterated that the leave (CCL) is to be treated like Earned Leave and sanctioned as such.



3. It is, therefore, clarified that the ‘total leave of all kinds’ as referred to in Para 6(a) of this Ministry’s G.M. dated 27.11.65 ibid, will include Child Care Leave for regulating grant of HRA during leave, subject to fulfiment of all other conditions stipulated thereuder, from time to time. It is also clarified that drawal of HRA during leave (including CCL) in excess of first 180 days, if otherwise admissible, shall be subject to furnishing of the certificate prescribed in Para 8(d).



4. These orders take effect from 01.09.2008. HRA during CCL, if not paid to women employees who are entitled to it as per this clarification, may be reconsidered, if so requested by the concerned employee.

BSF OFFICERS PETITIONED TO COURT FOR NFFU

                                      BSF officers move Delhi High Court



New Delhi, Aug 21: Over 100 BSF officers have petitioned the Delhi High Court against officials in the Union Home Ministry and IPS officers, who frame policies for them, alleging that they were subjected to 'acute stagnation' and deprivation of 'financial benefits'.



A bench comprising Justices Pradeep Nandrajog and Manmohan Singh had issued two separate notices to the Union Home Ministry and the BSF headquarters on Aug 14 seeking a response to the petition. Officers in the rank of Deputy Inspector Generals, Commandants, Deputy Commandants and Second-in-Command were among those who had submitted the petition.



It was a rare instance when officers of an armed force with the responsibility for the country's internal security approached the court to address their problem. They claimed that non-implementation of policy measures were affecting their morale and efficiency.



The BSF officials were angry over the fact that they were not given the non-functional financial benefits, despite a 2009 Department of Personnel and Training (DoPT) order.



The upgrading, according to the BSF officials, would ensure pay parity and social recognition. About 66 BSF officials signed the first petition that had been filed in the Delhi High Court while more sent similar representations later, said the counsel for these officials.



The aggrieved officials said the BSF's group 'A' officer, despite their selfless service, were being deprived of financial benefits and privileges which other group 'A' officers were enjoying and hence had no other option but to approach the court. They said such 'discrimination' was affecting the officer's morale and efficiency standards.



The BSF, with 2.4 lakh personnel, is the country's second-largest paramilitary outfit after the CRPF. It had made several representations to the Home Ministry but the latter was yet to take a final call on the matter.

Thursday, 16 August 2012 10:39 PNS n New Delhi ..inShare.0The CRPF has proved to be most gallant police force by bagging two Shaurya Chakras and 52 other gallantry medals this year.



Assistant Commandants Nagendra Singh and Vinoj P Joseph of 207 CoBRA Battalion were decorated with the coveted Shaurya Chakra—highest gallantry medal in peace time—for neutralising top Naxal leader Koteshwar Rao alias Kishanji, who was also a Politbureau and Central Committee Member of CPI (Maoist), near Jhargram in West Bengal.



The citation said the two officers planned a joint operation with the State police after receiving information on November 24, 2011 regarding movement of five to seven armed Maoists in the jungle area north of village Burisole, about 13 km from Jhagram.



“Assistant Commandant Nagendra Singh was hit and injured with a grenade splinter while AC Vinoj P Joseph was pinned down by a hail of bullets. A fierce battle took place between the Naxals and both officers. This sudden counter attack by the two commanders with a small team of five additional personnel to guard the flanks not only saved the other force personnel from any casualty but decisively unnerved the Maoists,” the spokesperson said.



In the CISF, Jaideep Prasad (IPS, 1995 batch, MP cadre) was awarded with Police Medal for Meritorious Service on the occasion of Independence Day-2012 for his consistent hard work, professionalism and extraordinary performance.



Prasad joined CISF in 2010 as DIG , Airport Sector (North Zone). Presently he is holding the charge of DIG (Operations and Intelligence) and Chief PRO at the CISF Headquarters here.



Prasad hails from Hazaribagh, Jharkhand and has displayed extraordinary courage in curbing dacoity menace in Chambal region for which he was earlier decorated with President’s Police Medal for Gallantry.

Subject:- Clarification on the admissibility of House Rent Allowance to the Central Government Employees posted at Greater Noida — regarding.





It has been observed that payment of HRA @ 30% of Basic Pay is being made by certain Ministries/Departments to the Central Government employees posted at Greater Noida, in violation of the instructions issued by this Ministry in this regard, from time to time.



2. It is, therefore, clarified that Greater Noida was an Unclassified’ town/place for the purpose of grant of HRA prior to 01/09/2008 and consequent upon the implementation of the recommendations of the 6th Central Pay Commission. it has been classified as ‘Z’ class town/place w.e.f. 01/09/2008 vide this Ministry’s O.M. No. 2(13)/2008-E-II(B) dated 29/08/2008 on grant of House Rent Allowance to the Central Government employees and classification of cities/towns for this purpose.



3. Financial Advisers of All Ministries/Departments are, therefore, requested to ensure the implementation of the aforesaid O.M. in letter & spirit

CENTRAL GOVT EMPLOYEES CENSUS

                                                               HIGHLIGHTS



(1). As per the result of Census Enquiries, the total regular employment under Central Government as on 31st March, 2009 was 30.99 lakh as against 31.12 lakh on 31 st March, 2008. The employment has, thus, recorded a decline of 0.42% in 2009 over 2008.





(2). Employment in Ministry of Railways was the highest (44.74%) followed by the Ministry of Home Affairs (24.14%), Defence civilian (11.77%), Communications & IT (7.06%) and Finance (3.49%). Other Ministries/Departments collectively shared the rest of 9% of the total Central Government regular employment.



(3). Out of 30.99 lakh regular employees, 3.11 lakh were women. The proportion of women in the total employment is almost static, around 10% in the year 2009, 2008 and 2006.



(4). About 95% of regular Central Government employees were Non-Gazetted. The overall ratio of Gazetted to Non-Gazetted employees was 1:19. In case of Ministry of Railways, however, this ratio was 1:114.



(5). Amongst regular Central Government employees, 63% were holding Group-‘C’ posts and 26% were in Group-‘D’ posts. About 8% were holding Group-‘B’ posts whereas employees holding Group –‘A’ posts were only about 3%.



(6). About 90% of regular Central Government employees were found in the Grade pay of Rs. upto 1800 to Rs. 5400 which mainly consists of Group ‘B’, Group ‘C’ and Group ‘D’ posts. Only 0.16% employees were in the highest scale i.e. HAG+Apex & Cabinet Secretary level.



(7). Amongst regular Central Government employees, 18% were working at offices located in ‘X’ class cities and 29% in ‘Y’ class cities. The percentage of employees in all the cities/areas other than class X and Y cities was 53%.



(8). Amongst States and Union Territory Administrations, the highest number of regular Central Government employees was in the State of Uttar Pradesh (9.51%) followed by Maharashtra (9.06%), West Bengal (8.54%), Delhi (6.55%), Andhra Pradesh (5.97%), Tamil Nadu (4.79%) and Madhya Pradesh (4.07%). In remaining States/U.Ts the proportion was less than 4%

TPT ALLOWANCE FOR NCR

Subject:- Payment of Transport Allowance to Central Government Employees in Fandabad, Gurgaon, Ghaizaibad and Noida.





It has been brought to the notice of this Ministry that some Central Government Offices located in Faridabad and Gurgaon are paying Transport Allowance to its employees at the rates other than that applicable to such areas and such payment is irregular It is clarified that the Central Government Employees posted at Faridabad, Gurgaon. Ghaziabad and Noida are entitled to Transport Allowance at the rates applicable to other places’ i.e. other than 13 classified cities as per the conditions laid down in this Ministry’s O.M. No. 21(2)/2008-E-II(B) dated 29.08.2008.
